Terms of Service

1. Services

Sudo Scale provides digital marketing and lead generation services, including targeted digital advertising campaigns, lead capture, qualification, real-time delivery, and related consulting services for businesses, professionals, and organizations.

2. Eligibility

You must be at least 18 years of age and have legal capacity to enter into a binding agreement. If using on behalf of a business, you represent authority to bind that entity.

3. Lead Delivery & Exclusivity

Leads are delivered on the terms specified in your campaign setup (either exclusive or shared). We make commercially reasonable efforts to ensure data accuracy but do not guarantee conversions, sales, or financial results.

4. Return & Replacement Policy

If you receive a lead with clearly invalid contact details (e.g. disconnected phone number) or a verified duplicate, you may request a replacement within 24 hours of delivery. All requests are subject to verification. Replacements are issued at our sole discretion and do not entitle the buyer to a cash refund.

5. Payment Terms

All lead purchases are prepaid. Payment is due in full before lead delivery begins. We do not offer net payment terms or invoicing. All sales are final except as described in Section 4. In the event of a chargeback or disputed payment, Sudo Scale reserves the right to suspend or terminate your account immediately and pursue recovery of amounts owed.

6. Acceptable Use & Compliance

You agree to use all leads and marketing assets solely for lawful purposes in compliance with all local, state, and federal regulations, including but not limited to:

• Telephone Consumer Protection Act (TCPA)
• CAN-SPAM Act
• Do Not Call (DNC) registries
• Applicable industry-specific regulations and licensing requirements

You are solely responsible for ensuring your use of leads complies with all applicable laws. Sudo Scale is not responsible for how leads are contacted or used after delivery.

7. SMS Notifications

By purchasing leads through Sudo Scale, you consent to receive SMS text message notifications regarding lead delivery. These notifications will be sent to the phone number provided during your purchase or onboarding.You may opt out of SMS notifications at any time by replying STOP to any message. For assistance, reply HELP or contact hello@sudoscale.co. Message and data rates may apply. Message frequency varies based on lead volume.

8. Termination

Either party may terminate the service relationship at any time with written notice to hello@sudoscale.co. Upon termination, any unused lead balance remaining in your account will be forfeited unless otherwise agreed in writing. Sudo Scale reserves the right to terminate any account immediately for violation of these Terms without refund.

9. Limitation of Liability

To the maximum extent permitted by law, Sudo Scale's total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount you paid to Sudo Scale in the 30 days preceding the claim. In no event shall Sudo Scale be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or lost revenue, even if advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sudo Scale LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of our leads or services, your violation of these Terms, or your violation of any applicable law or third-party right.

11. Governing Law

These Terms are governed by the laws of the State of California. Any disputes arising under these terms shall be resolved in the courts of Los Angeles County, California.
